Hire Contract Terms & Conditions

1. Definitions

Commencement Date means the later of:

the date stated on the Hire Agreement; or

the date the Equipment is delivered to the Customer.

Customer means the person, company or entity hiring the Equipment from Site Lock Security.

Equipment means the temporary security equipment supplied by Site Lock Security, including cameras, detectors, poles, solar panels, communication devices, trailers, mounting systems and related hardware.

Hire Charge means the amount payable by the Customer as stated in the Hire Agreement.

Hire Period means the period commencing on the Commencement Date and continuing until the Equipment is returned to and received by Site Lock Security, subject to any applicable minimum hire period.

2. Minimum Hire Period

Unless otherwise agreed by Site Lock Security in writing, the minimum Hire Period is three (3) calendar months from the Commencement Date.

If the Equipment is returned before expiry of the minimum Hire Period, the Customer remains liable for all Hire Charges applicable to the remainder of the minimum Hire Period.

3. Ownership and Risk

All Equipment remains the property of Site Lock Security at all times.

Risk in the Equipment passes to the Customer upon delivery and remains with the Customer until the Equipment is returned to and received by Site Lock Security.

4. Our Responsibilities

Site Lock Security agrees to:

provide the Equipment in clean and working condition;

provide reasonable technical support relating to the Equipment during the Hire Period;

repair or replace faulty Equipment where the fault has not been caused by misuse, damage, theft, negligence, unauthorised interference or breach of this agreement by the Customer; and

use reasonable efforts to collect the Equipment within 5 business days after receiving a written collection request.

5. Customer Responsibilities

The Customer agrees that it will:

use the Equipment only for lawful purposes and in a safe and proper manner;

comply with all laws, regulations and site requirements relating to the use of the Equipment;

not tamper with, modify, relocate, dismantle or attempt to repair the Equipment without prior written consent from Site Lock Security;

not sell, assign, sub-hire or part with possession of the Equipment;

keep the Equipment secure and protected from theft, vandalism, misuse and damage; and

immediately notify Site Lock Security in writing of any loss, theft, malfunction or damage involving the Equipment.

6. Responsibility for Loss or Damage

The Customer acknowledges and agrees that:

Site Lock Security’s insurance does not cover the Equipment while it is located on the Customer’s site or under the Customer’s control;

the Customer is fully responsible for all loss, theft, destruction or damage to the Equipment during the Hire Period; and

where Equipment is lost, stolen or damaged, the Customer must pay:the reasonable cost of repairs;the reasonable replacement cost of the Equipment if repair is not possible; andany reasonable transport, recovery or administrative costs incurred by Site Lock Security.

Site Lock Security strongly recommends that Customers arrange appropriate insurance coverage for the Equipment during the Hire Period.

7. Optional Third-Party Monitoring

Site Lock Security provides equipment hire and technical support only.

Any control room monitoring, alarm response or related services are optional third-party services provided independently by third-party providers under separate arrangements.

Site Lock Security does not provide security guarding or monitoring services and does not guarantee the prevention of theft, trespass, vandalism or other incidents.

8. Payments

The Customer agrees to:

pay all Hire Charges by the due date stated in the Hire Agreement;

pay all applicable GST, taxes, duties, delivery fees and collection charges; and

reimburse Site Lock Security for any costs incurred due to failed payments or dishonoured transactions.

If any amount remains unpaid after the due date:

interest may be charged at the rate of 2% per month, calculated daily; and

the Customer must reimburse Site Lock Security for all reasonable recovery costs, including legal fees, debt collection fees and administrative costs.

9. Limitation of Liability

To the maximum extent permitted by law, Site Lock Security excludes all liability for indirect, consequential or economic loss arising from the use or failure of the Equipment.

Nothing in these terms excludes any rights or guarantees that cannot lawfully be excluded under the Australian Consumer Law.

10. Termination

Site Lock Security may terminate the hire arrangement immediately if:

the Customer breaches these terms;

payments remain overdue; or

Site Lock Security reasonably believes the Equipment is at risk.

Upon termination, all outstanding amounts become immediately due and payable.

11. Governing Law

These terms are governed by the laws of Victoria, Australia.
